Pursuant to Vietnamese labor regulations, foreign employees eligible for the issuance of a Work Permit in Vietnam are classified into four (04) principal categories, as follows:
1. Manager
A Manager is a person who manages a private enterprise or a company, including but not limited to:

Owner of a private enterprise;

General partner;
-
Chairman of the Members’ Council;
-
Member of the Members’ Council;
-
Company Chairman;
-
Chairman of the Board of Directors;
-
Member of the Board of Directors;
-
Director or General Director; and
-
Other managerial positions as prescribed in the Company Charter.
This category also includes the head or deputy head of an agency or organization.
2. Executive Director
An Executive Director is the person who heads and directly manages a unit subordinate to an agency, organization, or enterprise.
3. Expert
An Expert is a foreign employee who satisfies one of the following conditions:

Holds a university degree or higher, or an equivalent qualification, and has at least two (02) years of work experience relevant to the position that the foreign employee is expected to undertake in Vietnam; or
-
Possesses specialized knowledge, professional qualifications, and experience recognized by competent authorities in accordance with Vietnamese law.
4. Technical Worker
A Technical Worker is a foreign employee who satisfies one of the following conditions:

Has undergone at least one (01) year of technical training and has at least two (02) years of work experience relevant to the position that the foreign employee is expected to undertake in Vietnam; or
-
Has at least three (03) years of work experience relevant to the position that the foreign employee is expected to undertake in Vietnam.
